Nota's Commission Terms of Service

By agreeing to commission me, you as the commissioner accept my Terms of Service. Please make sure you read and review these terms carefully before proceeding. These terms are here to ensure that clear expectations are set between both parties to ensure a smooth process from start to finish.

A violation to these Terms of Service may and can result in a ban from commissioning me in the future.

Commission Guidelines and Protocols

When my commission status is open, the form will be open and be accepting responses. I will promote on my socials when I open alongside the number of commission slots available. The slot will be filled when I've reached out to the client and have agreed on the details of the request. I will update on the commission thread that a slot has been taken once the request has been finalised.

Commission requests are chosen on a first come first serve basis. I will state on social media when I will be opening up commissions ahead of time and how many slots I will open. Please make sure you have prepared all of the necessary information about your commission prior to the start date.

Once I have received your request, I will reach out through the preferred communication channel to discuss and provide a quote for the commission. Once the invoice has been sent and paid upfront, the commission work will officially begin.

If I am not able to reach out using the preferred channel, I will fallback to using the PayPal invoicing email. If the client has not heard back from me, the client should check both their email inbox and spam folder.

The drawing process from start to end are as follows

  1. Once payment is received, I will start on rough drafts and sketches
  2. Once the sketches have been approved, I will continue with lines
  3. Once the lines have been approved, I will continue the piece to completion
  4. Once the final drawing has been approved and signed-off, I will email the completed drawing to the provided email

Depending on my situation, estimated time of completion after receiving payment will vary from up to 7 days for the initial draft, then after the first approval up to a maximum of 90 days. I will be providing regular updates on the commission through the preferred communication channel for feedback and approvals.

As I am busy with full-time work during the day, I will try and complete the drawings within my free time. I will also try and respond to any messages in a timely matter. Please be patient if I don't get back to you immediately.

Once the commission has been delivered, I will upload a scaled down lower quality version of the commissions to my social media along with the client's name if allowed as specified on the form.

All personal information will be kept private and confidential.

Trello Board

To keep track of the commission status, a Trello board is provided to give clients an overview for the overall progress.

The board has 5 lists:

  1. Queue: For slots that have been paid, but sitting in queue to be drafted
  2. Draft: For slots that have a draft in progress
  3. In Progress - Lines: For slots that have gotten approval for the draft and is in progress for the line art stage
  4. In Progress - Colours: For slots that have gotten approval for the line art stage and is in progress for completion
  5. Completed: For slots that have gotten approval for the final drawing and has been delivered to the client

Rules

I can draw:

  • Monsters
  • Humans (*)
  • Furries (*)
  • Animals & Quadrupeds (*)
  • Mechas and Robots (may incur complexity fee)
  • SFW/Questionable R-15 (if I am comfortable with it)

I will not draw:

  • NSFW
  • Extreme violence and gore
  • Real people
  • Fetishes
  • Anything that I am not comfortable with

(*) I draw these less often so please keep that in mind if you're thinking about requesting these.

I have the right to decline any commission request that makes me feel uncomfortable in fulfilling. If you are unsure, please feel free to contact me message on my socials.

I will not accept your request without any image references. Providing only a written description without any image references makes the entire process more difficult to complete, resulting in a sub-par delivery. It is preferable that the client provides a detailed description for their request with at least one or more images for references. Please send SFW references only. It is recommended that the client also provides an example of my past works as a reference.

I WILL DECLINE THE REQUEST IF THE CLIENT PROVIDES AI REFERENCES.

I will not be providing any character design services. Character fusions might be possible but will be considered on a case by case basis. I have no experience in creating original designs and will reject any commission requesting as such. Please ensure that you have proper references before hand for your characters.

I also have the right to terminate a commission due to client behavior, in which case a partial refund will be provided depending on the current stage of the commission. Examples of client behavior that will lead to termination includes being rude, unpleasant or act in an obscene manner.

I also have the right to terminate a commission due to a change in my circumstances, in which case a full refund will be provided.

If I am not able to deliver the drawing within 90 days, a full refund will also be provided. This excludes any time between communications.

I will not be responsible for any errors or mistakes once the final version has been approved, completed and delivered. It is the client's responsibility to detect and provide feedback during the various stages of the commission.

Commission Types, Examples and Pricing

Some designs like Child level Digimon or some Pokemon have less complex design and may have a reduction in price. For example, a Fullbody Child level Digimon may be priced at a Waist up or Thigh up tier. This will change on a case by case basis.

If a design is complex, I will add on a complexity fee as I see fit. This will also change on a case by case basis. More than likely, it will add on an additional 10% to 50% depending on the commission type and character complexity.

Any major changes, such as adding an additional character, change from Thigh to Fullbody, large pose changes, etc after the sketch approval will incur a change fee. This will change on a case by case basis.

Minor changes will not incur any change fee. Such examples are:

  • Missing details
  • Different hand poses
  • Canvas size
  • Character rotation, etc
  • Proportion fixes
  • Colour errors

Any extra characters will add on top the existing price. For example, a commission for two rendered Fullbody characters will cost $85 + $85.

As of present, there are no detailed background options. A simple colour or gradient background can be used if desired at no extra cost.

Standard Rendered

Fully rendered and shaded drawings. This is the style that majority of my artworks are in. Default resolution is a square canvas at minimum 2048x2048 300DPI and can vary depending on the request.

Pixel Art

Shaded pixel art styled drawings. Default resolution is a square canvas at 256px or 128px 300DPI and will provide a 4x or 8x integer scaled version. Resolution and palette can vary depending on the request. Can use a specified colour palette if provided. Optionally, can provide an LCD screen effect if requested.

Standard Flat

Plain coloured drawings. Contains the same style as the Standard Rendered without rendering and minimal shading. Default resolution is a square canvas at minimum 2048x2048 300DPI and can vary depending on the request.

Payment and Refund Policy

My preferred choice for accepting payments is through Stripe, in USD. Once a quote is created and the client agrees on the price, I will send a payment link containing the due amount.

As an alternative option, PayPal can also be used to accept payment. I will send an invoice to the provided PayPal email address once a quote is created and the client agrees on the price.

Once the client receives the payment method, the client will have up to one week to make the payment in full. Failure to do so will cause the client to forfeit their slot in queue. I will be sending out reminders throughout this period.

I will not start any work until payment has been received.

As mentioned above, partial refunds will be provided depending on which stage of the commission is in if a termination of the commission were to happen.

  • After the sketch has been approved, a 66% refund will be provided
  • After the line art has been approved, a 33% refund will be provided
  • After the final drawing has been approved, no refunds will be provided

Image Rights and Usage

I reserve full rights to the image and how it is distributed and use, unless stated otherwise. The client can request the commission to be anonymous and if the commission is to stay private.

COMMERCIAL USE FOR PROFITING PURPOSE IS STRICTLY FORBIDDEN AT THIS TIME. UNDER NO CIRCUMSTANCES IS THE CLIENT PERMITTED TO REDISTRIBUTE THE COMMISSION BY WAY OF PRINTS, STICKERS, ETC. ADDITIONALLY, THE CLIENT IS NOT PERMITTED TO MODIFY, OBSTRUCT OR REMOVE THE ARTIST SIGNATURE IN ANY WAY (WITH THE EXCEPTION OF CROPPING FOR USE OF AN AVATAR).

USE FOR TRAINING AN AI MODEL ON THE COMMISSIONED WORK IS STRICTLY FORBIDDEN.

Use of commission work for streaming is allowed with attribution, including: use for promotion; emotes; stream art; etc.

Personal use for the commission is allowed, including: Wallpapers and background; personal prints and stickers; avatars and icons for social media; etc.

The client is allowed to upload the final commission to any online platform as long as they do not claim the artwork as their own and proper credit is given along side a link to any of my socials.
